The Family Law Amendment (Information Sharing) Act 2023 - what you need to know
The introduction of the Family Law Amendment (Information Sharing) Act 2023 aims to improve the communication and information sharing between the Court, child protection agencies and police to protect children from family violence and child abuse and neglect.
Key points of this act include:
Two new information sharing orders have been established which will enable the courts to seek information from police, state and territory child protection and firearm agencies to assist in decision-making relevant to prioritising the safety of parties in a family law matter.
This information can be accessed at any time during a proceeding to ensure it is accurate and up to date to enable informed decision making especially where there are concerns of violence, neglect or abuse that may endanger children.
The act also considers the appropriate process to ensure sensitive information is disclosed appropriately and safely.
The provisions in the Family Law Amendment (Information Sharing) Act 2023 will commence on the 6th May 2024 and will apply to all new and existing parenting proceedings that are underway.
