Essential Tips for Preparing for Your Family Law Court Appearance
Facing a family law court appearance can be a daunting experience, especially if it’s your first time. Whether you’re addressing parenting arrangements, property settlements, or other family law issues, it's essential to be well-prepared. Careful planning and a clear understanding of the court process are key to navigating the experience successfully.
Understanding the Family Law Court Process
Before you step into a family law court, it’s important to understand the process. Familiarising yourself with the court proceedings will help you feel more confident and prepared. For more details, have a read of our blog What to expect if you go to court.
Organise care for your Children
Unless requested by the Court or a Court member, children should not be present in court during family law matters. As the timing of the day could be unpredictable, it's important to have care arrangements in place for your children for the entire day in case your matter is delayed or runs longer than expected.
Your Personal Safety in Family Court
If you have concerns about your safety when attending Court, please be assured there are safety measures in place to protect you and your family. We can request the court make alternative arrangements, but this needs to be done at least 5 days before the court event.
Have a Support Person
It’s a good idea to bring a support person along, although they will not be allowed to sit at the bar table with you unless you are not legally represented. We understand that attending court can be a significant and stressful life event, and having someone there for support can be comforting when you need it.
How to Dress and Present Yourself in Family Court
There are no formal rules about what you should wear to a family law court appearance. However, it is a setting that requires appropriate dress. You should present yourself in clean and tidy clothing, which ideally should be smart casual or a semi-formal office wear if possible and no hats or caps.
Allow sufficient time
Please allow sufficient time when you arrive at court to pass through security and find the courtroom. We want you to feel as relaxed as possible and not stressed rushing to find where you need to be.
Inside the court room
Once inside the court room, ensure your mobile phone is switched off. Be polite to the Judge, Registrar, the other party and their legal advisor/s and stand when you speak to the Judge. You should address the judge as “Your Honour”. Always remain respectful in your demeanour, even if you disagree with what others might be saying.
Working with Your Family Lawyer
Collaborating with your family lawyer is essential for a successful court appearance. We’ll prepare you before your appearance by running you through the process and reviewing your affidavit so you are prepared to communicate with the Judge, and respond to the other party.
Remember, working closely with your family lawyer is the best way to ensure you’re fully prepared and have the best chance of a favourable outcome.
