Why a Will is so important?

Poorly written Wills can result in months, or potentially years of dispute after your passing.

If you’re aged 18 or over, ensuring that you have a current and valid Will is the best way to ensure that those you love most, and care for, are adequately provided for once you pass away. It is one of the most important documents you will ever sign.

A Will is much more than a document stating who will receive your personal belongings if you were to pass. It’s a way for you to communicate exactly how you want your estate to be distributed between family, friends and/or charities. It is recommended that you update or create a new Will whenever there has been a change in circumstances, to ensure that your Will is current with your wishes.

If you die without a valid Will, the intestacy rules that apply from the Australian and State law will determine how your assets are distributed.

What can I include in my Will?

You can include the distribution of assets such as property, cash, savings, investments, personal belongings, and instructions for guardianship of minor children. You can also outline specific bequests, set up trusts, or detail funeral wishes.

What happens if I die without a Will (intestate)?

If you die without a Will, your estate will be distributed according to the Succession Act 2006, which outlines a predetermined formula that may not align with your wishes. Your assets are typically distributed to your spouse, children, or closest relatives, but this process can be more complex and lead to disputes​.

What is an executor, and what do they do?

An executor is the person you name in your Will to manage your estate after your death. Their duties include applying for probate, paying debts, and distributing assets according to your Will. It’s important to choose someone you trust, as the executor plays a critical role in the estate administration process​.

What are letters of administration?

Letters of Administration is a document providing the Court’s formal approval for someone to administer the estate of the deceased. Letters of Administration are required if you pass away intestate which means you die without a valid Will in place.

The Letters of Administration grant the administrator the legal authority to manage and distribute the deceased person’s assets, settle debts and liabilities, and carry out other responsibilities related to the estate’s administration. The administrator is typically a close family member, such as a surviving spouse or adult child, but in some cases, a Court may appoint a neutral third party, like a lawyer or a professional estate administrator.

Who can make a Will in NSW?

In NSW, anyone aged 18 or older and of sound mind can make a Will. Those under 18 can only create a Will if they are married or have received Court approval. The person making the Will must have testamentary capacity, meaning they understand the nature and consequences of making a Will, the extent of their assets, and the potential claims against their estate​.

Can I change my Will?

Yes, you can change your Will at any time as long as you have the mental capacity to do so. Changes can be made using a codicil (an amendment to the existing Will) or by creating a new Will, which automatically revokes the previous one. It is advisable to consult a lawyer to ensure changes are valid and legally binding​.

How can I ensure my Will is legally binding?

For a Will to be valid in NSW, it must be:

  • Written (typed or handwritten).
  • Signed by the Will-maker in the presence of two independent witnesses, who must also sign the document in the Will-maker’s presence.
  • Free from undue influence, fraud, or forgery​.
What is probate, and is it always required?

Probate is the legal process of proving and registering a Will in the Supreme Court of NSW. It grants the executor authority to manage the estate. Probate is usually required if the estate includes property, large bank balances, or shares, but smaller estates may not require it​.
